Universal Terms of Service & Privacy Policy
This document governs your use of all Load Magic Ltd digital products, including but not limited to websites, APIs, applications, AI systems, plugins, and online platforms (collectively the "Services"). By creating an account, installing, or using any Service, you agree to these Terms and this Privacy Policy.
1. Overview (Summary)
- Applies to all Load Magic products – including AI tools, plugins, dashboards, APIs, and other software solutions.
- Use responsibly – follow data protection and security best practices; don't upload confidential or production data unless authorised.
- Per-user API licensing – access (including API keys) is licensed to named individuals only; no sharing or concurrent use of a single key across multiple users or workflows, and we may monitor usage to enforce this.
- Analytics with consent – we may analyse anonymised usage to improve performance, but not for advertising.
- Beta features – some functions are experimental and may change or be withdrawn.
- Limited liability – Services are provided as-is under English law.
- Privacy protection – compliant with UK GDPR and PECR.
2. Definitions
- "Load Magic," "we," "us," refers to Load Magic Ltd.
- "You," "Customer," or "User" means any individual or organisation using our Services.
- "Services" means all software, APIs, websites, AI systems, plugins, or other digital tools developed or operated by Load Magic Ltd, whether free, beta, or paid.
- "Customer Content" means data, materials, or information you upload, process, or provide via the Services.
3. Eligibility & Accounts
- You must be at least 18 and have authority to bind your organisation if using on its behalf.
- Keep credentials confidential; you are responsible for all activity under your account.
- We may suspend or terminate accounts for security, misuse, or non-payment.
4. Licence & Acceptable Use
We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Services in accordance with these Terms.
You must not:
- Reverse-engineer or attempt to derive source code (except as permitted by law).
- Resell, sublicense, or misrepresent affiliation.
- Introduce malware, disrupt others, or misuse our APIs or infrastructure.
- Upload unlawful, harmful, or confidential third-party data without authority.
Export compliance: You must obey all applicable export and sanctions laws.
4.1 API Keys & Per-User Licensing
Per-user licensing. Each LoadMagic.ai account is licensed to a single named individual. API keys issued to that user are personal to them and must not be shared, transferred, or used by any other individual, system, or automated process acting on behalf of a different user, except as expressly permitted in an enterprise subscription.
Authorised use. You may utilise your LoadMagic.ai API key solely for your own work and within the scope of your subscription plan. Enterprise plans may permit multiple users, each of whom will receive their own API key. API keys must only be used in accordance with the permitted number of users, machines, workflows, and environments defined under the applicable subscription.
Prohibited concurrent use. Unless explicitly authorised under an enterprise plan, any concurrent or simultaneous use of a single user’s API key across multiple independent workflows, projects, environments, or machines is prohibited. You must not use an API key in a way that attempts to circumvent per-user licensing or usage restrictions.
Monitoring and enforcement. LoadMagic.ai may monitor API usage patterns to verify compliance with licence terms and to protect the integrity and security of the Services. The specific methods used to verify compliance are confidential and may change over time. You agree not to interfere with, disable, or attempt to circumvent any usage verification, rate limiting, or licensing controls.
Suspension and termination. Where usage patterns indicate that an API key or account is being used in a way that breaches these Terms & Conditions — including use suggestive of key sharing, unauthorised concurrency, automated misuse, or any other activity inconsistent with the permitted licence scope — LoadMagic.ai may temporarily suspend or restrict the relevant account or API key pending review, in addition to any other rights of suspension or termination set out in these Terms.
Enterprise responsibility. For enterprise subscriptions, the organisation is responsible for ensuring that all users under its account adhere to these API key licensing terms. Each authorised user must use their own individual API key and must not share it with others.
5. Data Responsibility & Security
Unless we've agreed additional safeguards, use only non‑sensitive or test data.
You are responsible for:
- ensuring you have lawful grounds to upload any personal data,
- removing confidential or production data unless protected by a written agreement, and
- maintaining appropriate local backups.
We apply reasonable technical and organisational security controls (see https://loadmagic.ai/infosec), but no system is perfectly secure.
If you believe production data use is required, contact [email protected] to agree a Data Processing Addendum (DPA) and enhanced measures (e.g., encryption, isolation, restricted access).
6. Beta, Experimental & Evolving Features
Certain features may be offered as Beta, Preview, or Experimental. These are provided as-is, may contain bugs, and can be changed or withdrawn without notice. Feedback may be used freely to improve our products. No SLA applies to such features.
6.1 Optional Video, Audio & Screenshare Recordings
From time to time we may invite you to take part in optional feedback or research sessions (for example onboarding calls, user interviews, co-design workshops, or screen-shares) (collectively, "Beta Sessions"). Participation in any Beta Session is voluntary and not required to use the Services.
With your explicit consent at the start of a Beta Session, we may record audio, video, your screen, and in-product interactions. We use these recordings to: (i) understand how the Services are used and improve design, performance, and reliability; and (ii) create internal training materials and product documentation. Where you have given separate marketing consent, we may also use selected excerpts (for example, testimonials or workflow demonstrations) in external marketing or educational content to help other users understand potential benefits of the Services.
Where recordings are used for external marketing or educational content, we will either obtain your explicit approval of the proposed use or anonymise or mask personal data and commercially sensitive information.
Recordings will be stored securely, accessed only by authorised personnel, and retained only for as long as reasonably necessary for the purposes described above, after which they may be deleted or anonymised. You may withdraw your consent to future use of your recordings at any time by contacting [email protected]. This does not affect the lawfulness of any use prior to withdrawal.
7. Plans, Billing & Commercial Readiness
Applies when paid tiers or subscriptions are available.
- Subscriptions: Fees are billed in advance on a recurring basis unless otherwise specified.
- Trials: Trial access may convert to paid unless cancelled before the end date.
- Upgrades/Downgrades: Adjustments take effect the next billing cycle.
- Refunds: Except where legally required, fees are non‑refundable.
- Suspension: We may pause Services for non-payment after reasonable notice.
- No implied SLA unless agreed in writing.
8. Intellectual Property
- Your Content: You own your data and grant us a limited licence to host, process, and display it solely to operate and improve the Services.
- Aggregated/Anonymised Data: We may derive and retain anonymised analytics for performance and research.
- Feedback: You assign all rights in suggestions and waive moral rights where permitted.
- Our IP: We retain all rights in the Services, documentation, and brand.

9.2 What We Collect
- Account data: name, email, organisation, authentication info.
- Usage data: IP, browser/device, session info, timestamps, feature interactions, performance metrics.
- Communication data: messages, support tickets, survey responses.
- Billing data (where applicable): subscription details and transaction metadata (payment details handled by processor).
9.3 Purposes & Legal Bases
- Provide, secure, and maintain the Services (contract; legitimate interests).
- Improve features and reliability (legitimate interests).
- Communicate with users (contract; legitimate interests).
- Compliance and fraud prevention (legal obligations).
- Optional marketing or research (consent).
9.4 Analytics Consent (Soft Opt‑in)
We use privacy‑respecting analytics to improve performance, not for advertising.
- You may opt in to analytics at sign-up or later.
- You may withdraw consent anytime via settings or by contacting us.
- Analytics cookies or identifiers are only set after opt‑in per UK PECR.
9.5 Sharing & Transfers
- Data may be processed by trusted service providers (hosting, communications, analytics) under written contracts.
- Where transferred outside the UK/EEA, we use approved safeguards (UK IDTA, SCCs, etc.).
- We never sell personal data.
9.6 Retention
We retain personal data as long as needed to operate or comply with legal duties, then delete or anonymise it. Typical retention: active account data – life of account; support records – up to 6 years.
9.7 Your Rights
You may request access, rectification, deletion, restriction, portability, or objection under UK GDPR. Contact [email protected]. You can complain to the ICO (https://ico.org.uk).
10. Data Processing Addendum (DPA)
If you or your organisation act as Controller and Load Magic processes Customer Content on your behalf, a separate DPA will apply incorporating UK GDPR Article 28 terms and international safeguards. Until executed, you should not upload personal data.
11. Support, Updates & Changes
We may provide updates, bug fixes, or new features. We may modify these Terms with notice. Continuing to use the Services means you accept the revised version.
12. Disclaimers & Limitation of Liability
Nothing excludes liability for death/personal injury from negligence, fraud, or matters that cannot be excluded by law.
Otherwise:
- Services are provided "AS IS" and "AS AVAILABLE."
- We disclaim warranties of merchantability, fitness, or non‑infringement.
- We are not liable for indirect, incidental, or consequential losses, including profit, data, or business loss.
- Aggregate liability is capped at the lower of (i) fees paid in the last 12 months or (ii) £5,000.
- Beta/experimental features: liability cap £0 (where lawful).
13. Termination
You may stop using the Services anytime. We may suspend or terminate access for breach, non‑payment, or legal reasons. Upon termination, your licence ends, and we may delete data after a reasonable export window.
14. Confidentiality & Responsible Disclosure
Non‑public pre‑release information remains confidential for two years after disclosure unless made public by us. Report security issues to [email protected]; do not disclose until resolved or mutually agreed.
15. Acceptable Use Summary
- No unlawful, abusive, or high‑risk use (medical/safety‑critical) without written consent.
- No attempts to bypass security or overuse APIs.
- No spamming, scraping, or unauthorised resale.
16. Third‑Party Links & Integrations
Our Services may integrate with or link to third‑party tools. Their terms and privacy policies apply independently.
17. Notices, Assignment & Miscellaneous
- Notices: via your registered email or on-site messages.
- Assignment: You may not assign without consent; we may assign to successors.
- Severability: Invalid terms do not affect the remainder.
- Entire Agreement: These Terms and referenced policies are the full agreement between you and Load Magic.
18. Governing Law & Jurisdiction
These Terms are governed by the laws of England & Wales. The courts of England & Wales have exclusive jurisdiction.
